1. Introduction

These Terms and Conditions ("Terms") govern your access to and use of the Arriba Event Rentals website, applications, and rental services (collectively, the "Service") operated by Arriba Event Rentals ("Arriba," "we," "us," or "our"). By placing an order, creating an account, or otherwise using the Service, you ("Customer," "you," or "your") agree to be bound by these Terms. If you do not agree, you must not use the Service.

2. Eligibility & Accounts

You must be at least 18 years of age and legally able to enter into a binding contract. When you create an account through our OAuth2 sign-in (Google, Facebook, or Apple), we automatically provision a customer record using the name and email address provided by your identity provider. You are responsible for maintaining the accuracy of your account information and the confidentiality of your login credentials.

If you are agreeing to these Terms on behalf of a company or other legal entity, you represent that you have authority to bind that entity.

3. Placing a Rental Order

All rental orders are placed through the Service. To place an order you must:

  1. Select your event dates. Choose a start date and end date for your rental period using the date picker. The rental duration is calculated as the number of days between these dates (minimum one day).
  2. Choose a fulfillment method. Select either Delivery (we bring items to your venue) or Pickup (you collect items from one of our warehouse locations). If Delivery is selected, you must provide a valid delivery address within our service area.
  3. Add products to your cart. Browse our catalog and add available rental items in the desired quantities.
  4. Provide contact information. A point-of-contact name is required for every order. A phone number and special instructions are optional but recommended.
  5. Submit payment. Complete checkout by submitting payment. Your order is not confirmed until payment has been successfully processed.

Product availability is subject to change. We reserve the right to cancel or modify an order if any item becomes unavailable after you place your order, in which case we will notify you and issue a refund for the affected items.

4. Fulfillment — Delivery & Pickup

4.1 Delivery

Delivery is available to addresses within our service area (currently up to 45 miles from the nearest Arriba warehouse location). Delivery charges include a base delivery fee plus a per-mile charge calculated from the nearest delivery-enabled location. A delivery quote is provided during checkout before you confirm the order.

Delivery windows may be requested during checkout. Tighter delivery windows (e.g., one-hour or two-hour windows) may carry an additional charge. Arriba will make commercially reasonable efforts to deliver within the requested window but does not guarantee exact delivery times.

You or your designated point of contact must be present at the delivery address to receive the items. If no one is available, Arriba may leave the items at the address at your sole risk, or reschedule delivery at an additional cost.

4.2 Pickup

If you choose Pickup, you must collect the rental items from the designated Arriba warehouse location selected during checkout. You are responsible for providing adequate transportation to safely transport the items. Arriba staff may provide assisted loading when available, but safe transport from the warehouse is your responsibility.

4.3 Returns

All rental items must be returned by the reserved end date. For Delivery orders, Arriba will collect the items from the delivery address. For Pickup orders, you must return items to the same warehouse location. Late returns may incur additional daily rental charges at the standard per-day rate until the items are received.

5. Pricing & Payment

Rental prices are displayed per charge unit (typically per day) on each product listing. The total rental cost is calculated as the per-unit price multiplied by the quantity and the rental duration in days, plus any applicable delivery charges and taxes.

We accept payments via credit/debit card processed through our secure payment provider (Stripe). A deposit may be required at checkout, with the remaining balance due before or upon fulfillment. All amounts are in U.S. Dollars (USD).

You agree that the price displayed at checkout, including delivery charges and applicable taxes, constitutes the total amount you authorize us to charge. Arriba reserves the right to adjust pricing at any time; however, price changes will not affect orders that have already been confirmed and paid.

6. Cancellation & Refunds

You may cancel a confirmed order by contacting us at support@arribarentals.com. Cancellation policies are as follows:

  • More than 14 days before the event start date: Full refund, less a 5% processing fee.
  • 7–14 days before the event start date: 50% refund.
  • Less than 7 days before the event start date: No refund.

Refunds are issued to the original payment method and may take 5–10 business days to appear on your statement. Arriba reserves the right to waive or modify cancellation fees at its sole discretion.

7. Damage, Loss & Liability

You are responsible for all rental items from the time of delivery or pickup until the items are returned to and inspected by Arriba. Normal wear and tear is expected; however, you will be charged for:

  • Damage beyond normal wear and tear
  • Missing or lost items
  • Excessive cleaning required due to misuse

Damage and loss charges will be assessed at the replacement or repair cost of the item and may be charged to the payment method on file. You agree to inspect items upon receipt and notify Arriba of any pre-existing damage within 24 hours.

8. Intellectual Property

All content on the Service — including text, images, logos, product photographs, and software — is the property of Arriba Event Rentals or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content without our prior written consent.

9. Privacy

Your use of the Service is also governed by our Privacy Policy. By using the Service you consent to the collection and use of your information as described therein, including your name, email, delivery address, and payment information necessary to process your orders.

10. Prohibited Uses

You agree not to:

  • Use the Service for any unlawful purpose
  • Interfere with or disrupt the Service or its infrastructure
  • Attempt to gain unauthorized access to other accounts or systems
  • Scrape, crawl, or harvest data from the Service
  • Impersonate another person or misrepresent your affiliation
  • Use rental items for any illegal activity
  • Sub-rent or transfer rental items to third parties without written consent

11. Disclaimer of Warranties

The Service and all rental items are provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Arriba does not warrant that the Service will be uninterrupted, error-free, or secure.

12. Limitation of Liability

To the fullest extent permitted by law, Arriba Event Rentals, its affiliates, officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising from your use of the Service or rental items.

Under no circumstances shall Arriba Event Rentals' total aggregate liability to you exceed the total amount you actually paid for the specific order giving rise to the claim. In no event will Arriba Event Rentals be held liable for any amount greater than the total charges paid by you for the applicable rental order.

13. SMS / Text Messaging

By providing your phone number and opting in to receive text messages from Arriba Event Rentals, you consent to receive recurring automated SMS/MMS messages related to your rental orders, including but not limited to: order confirmations, delivery and pickup notifications, bay access codes, scheduling updates, and customer service communications.

13.1 Message Frequency

Message frequency varies based on your order activity. You may receive up to approximately 10 messages per month during active rental periods. Message frequency may increase around your reservation dates.

13.2 Opting Out

You may opt out of receiving text messages at any time by replying STOP to any message you receive from us. After opting out, you will receive a one-time confirmation message. Please note that opting out of text messages may affect our ability to send you time-sensitive information such as bay access codes and delivery updates.

13.3 Help & Customer Care

13.4 Carrier Disclaimer

US carriers are not liable for delayed or undelivered messages. Arriba Event Rentals is not responsible for any delays, failures to deliver, or errors in the content of SMS/MMS messages resulting from carrier network issues, device incompatibility, or other circumstances beyond our reasonable control. Message and data rates may apply. Consult your mobile carrier for details regarding your text messaging plan.

14. Indemnification

You agree to defend, indemnify, and hold harmless Arriba Event Rentals, its affiliates, officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from: (a) your use of the Service or rental items; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) any damage caused to rental items while in your possession.

15. Force Majeure

Neither party shall be liable for any failure or delay in performance due to circumstances beyond its reasonable control, including but not limited to natural disasters, severe weather, pandemics, government actions, labor disputes, supply chain disruptions, or other unforeseen circumstances. In such cases, Arriba will work with you to reschedule or cancel your order and issue an appropriate refund.

16. Governing Law & Disputes

These Terms shall be governed by and construed in accordance with the laws of the State of Minnesota, without regard to conflict-of-law principles. Any dispute arising under these Terms shall be resolved exclusively in the state or federal courts located in Minnesota, and you consent to the personal jurisdiction of such courts.

17. Changes to These Terms

We reserve the right to update or modify these Terms at any time. The most current version will always be available on the Service. Material changes will be communicated on the Service. Your continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.

18. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
